Under the FREDERAL DIGITAL MILLENNIUM COPYRIGHT ACT:

Copyright protection subsists from the time the work is created in fixed form. The copyright in the work of authorship immediately becomes the property of the author who created the work. Only the author or those deriving their rights through the author can rightfully claim copyright.

 

Title 17, U.S. Code, Section 106 of the 1976 Copyright Act gives the owner of copyright the exclusive right to do and to authorize others to do the following:

- To reproduce the work in copies;
- To prepare derivative works based upon the work;
- To distribute copies of the work to the public by sale or other transfer;
- To display the copyrighted work publicly.

 

Purchase Agreement:

 

 In purchasing Frederick County GIS digital data, I understand that all of the digital data is under copyright protection, I may produce and sell printed/digital media, and I agree that I will not sell, distribute or transfer the digital planimetric data that I am purchasing without the express agreement and authorization of Frederick County GIS. In addition, proper citation must be given to Frederick County on any printed/digital media.

 

Frederick County’s Digital Data under copyright includes:

Any and all Orthophotography in .tif, .wtf, .sid, and/or .sdw formats.

Any and all Planimetric data in CAD (.dxf) or ESRI formats (Shapefiles, Geodatabases)

Any and all Contour data in CAD (.dxf) or ESRI formats (Shapefiles, Geodatabases)
